1. Scope

This privacy statement is valid for Delacon and all its subsidiaries.

 

2. Purpose of data processing

Delacon processes personal data of employees, partners, (potential) customers and suppliers for the purpose of performance business and fulfilling related legal and contractual requirements.

2.1 Processing of personal data of customer and supplier

Delacon processes the personal data provided by interested parties, customers and suppliers for the preparation of offers and the processing of assignments as well as the fulfillment of the associated contractual and legal obligations. To fulfill legal obligations, the data is also forwarded to public authorities and service providers.

2.2 Applicants

The contact details and application documents submitted in the course of an application will be electronically processed by us for the purpose of selecting suitable candidates for employment.

In case of cancellation, the application documents will only be kept in evidence, if the applicant consents.

2.3 Website & Cookies

2.3.1 IP address

By visiting our website, information is automatically stored on the web server. This includes the browser used to visit our website, the operating system used, the page, that referred to our website, the IP address, the time of access and other information. These data is pseudonymized from Delacon point of view and cannot be used to identify a unique person without additional data sources.

Delacon does not evaluate this data as long as there is no illegal use of the website.

2.3.2 Google-Analytics

The website uses Google Analytics, a web analytics service provided by Google Inc. (“Google”). Google Analytics uses so-called “cookies”, text files that are stored on your computer and that allow an analysis of the use of the website by you. The information generated by the cookie about your use of this website (including your IP address) is transmitted to and stored by Google on servers in the United States. Google will use this information to evaluate your use of the website, to compile reports on website activity for website operators and to provide other services related to website activity and internet usage. Google may also transfer this information to third parties if required by law or as far as third parties process this data on behalf of Google. Google will in no case associate your IP address with other Google data. You can prevent the installation of cookies by setting your browser software accordingly; However, please be aware that in this case you may not be able to fully use all the features of this website. By using this website, you consent to the processing of data about you by Google in the manner and for the purposes set out above.

2.3.3. Embedded Youtube-Videos

On some of our websites we embed Youtube videos. The corresponding plug-ins are operated by YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA. When you visit a page with the YouTube plug-in, it will connect to Youtube’s servers. Youtube will be informed which pages you visit. If you are logged into your Youtube account, Youtube can assign your surfing behavior to you personally. This can be prevented by logging out of your Youtube account before.

If a Youtube video is started, the provider uses cookies that collect information about user behavior.

Anyone who has disabled the storage of cookies for the Google Ad program will not have to expect such cookies when watching YouTube videos. Youtube also stores non-personal usage information in other cookies. If you want to prevent this, you must block the storage of cookies in the browser.

2.3.3 Google Ads

Our website uses Google Conversion Tracking. If you have reached our website via an advertisement sent by Google, Google Ads will set a cookie on your computer. The conversion tracking cookie is set when a user clicks on a Google-served ad. These cookies lose their validity after 30 days and are not used for personal identification. If the user visits certain pages on our website and the cookie has not expired, we and Google may recognize that the user clicked on the ad and was redirected to this page. Each Google Ads customer receives a different cookie. Cookies can not be tracked through Ads advertisers’ websites. The information gathered using the conversion cookie is used to generate conversion statistics for Ads advertisers who have opted for conversion tracking. Customers are told the total number of users who clicked on their ad and were redirected to a conversion tracking tag page. However, they do not receive information that personally identifies users.
If you do not want to participate in the tracking, you can refuse the required setting of a cookie – for example via a browser setting that generally disables the automatic setting of cookies or sets your browser to block cookies from the domain “googleleadservices.com”.
Please note that you can not delete the opt-out cookies as long as you do not want to record measurement data. If you have deleted all your cookies in the browser, you must set the respective opt-out cookie again.

2.3.3 Social Media Plugins

Our website uses plugins for social media. These plugins are only activated by the visitor by clicking on the website. Delacon does not process any personal data here.

2.4 Newsletter

We will use the name and email address provided by you while signing up for the newsletter to keep you up to date on company news and current offers.

If you no longer wish to receive the newsletter, you can object to it at any time. You can use the unsubscribe link contained in every e-mail.

2.5. Tech Talk

As a service we provide on our website technical articles and interviews, white papers and dossiers. These are partly public, partly only available on request via the contact form provided for this purpose.

2.6. Facebook Pixel

We use the “visitor action pixels” from Facebook Inc (1 Hacker Way, Menlo Park, CA 94025, USA, or, if you are based in the EU, Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (“Facebook”)) on our website.

This allows user behavior to be tracked after they have been redirected to the provider’s website by clicking on a Facebook ad. This enables us to measure the effectiveness of Facebook ads for statistical and market research purposes. The data collected in this way is anonymous to us, i.e. we do not see the personal data of individual users. However, this data is stored and processed by Facebook, which is why we are informing you, based on our knowledge of the situation. Facebook may link this information to your Facebook account and also use it for its own promotional purposes, in accordance with Facebook’s Data Usage Policy https://www.facebook.com/about/privacy/. You can allow Facebook and its partners to place ads on and off Facebook. A cookie may also be stored on your computer for these purposes.

The legal basis for the use of this service is Art. 6 paragraph 1 sentence 1 letter f GDPR. Facebook is certified under the Privacy Shield Agreement and thus guarantees compliance with European data protection legislation (https://www.privacyshield.gov/participant?id=a2zt0000000GnywAAC&status=Active).

2.7. LinkedIn Tracking

LinkedIn conversion tracking is an analytical function powered by the LinkedIn Insight Tag. Conversions are actions a member makes that are valuable to your business. Conversion tracking gathers insights into post-click and view-through conversions of your LinkedIn ads campaigns, giving you the ability to measure the impact and ROI of your ads.

3. Principles relating to processing of personal data

The processing of personal data is based on strict principles, which regard the protection and security of the data as well as the rights of the data subject’s as the highest assets.

Lawfulness & transparency

Data processing is lawful, transparent and fair. Upon collecting the data, the data subject will be informed about the planned processing and handling of the data. Thus, data subjects are informed at least about the following points:

  • Controller of the data processing
  • Purpose of the data processing
  • Legal basis of the processing

Purpose limitation

The data is collected and processed for specified, explicit and legitimate purposes. The processing of the data does not take place in a manner incompatible with these purposes.

Data minimization

Only those data is collected and processed which is absolutely necessary for the stated purposes. If it is possible to achieve the purpose with reasonable effort, only anonymous data shall be processed.

Storage limitation & erasure

Personal data is deleted as soon as the purpose for which it was originally collected expires, provided there are no legal retention periods that prevent deletion.

If, in individual cases, there are legitimate interests in further processing these data, they will continue to be stored until the interest worthy of protection has been legally clarified.

Data protection

Personal data is subject to data secrecy. The data is to be handled confidential and protected by appropriate organizational and technical measures against unauthorized access, unlawful manipulation or disclosure as well as loss and destruction.

Accuracy

Personal data is to be kept correct, complete and up-to-date. Appropriate measures are taken to correct outdated, incorrect or incomplete data.

 

4. Non-Disclosure agreement

All employees of Delacon and its subsidiaries are contractually bound to secrecy and are regularly advised and trained on the secure handling of personal and other critical data.

 

5. Data Protection

Protecting the confidentiality, availability and integrity of data is an essential task of Delacon. This applies equally to trade secrets, customer data, personal data and other critical information.

For this purpose, state of the art technical and organizational security measures are established and constantly improved.

 

6. Data protection officer

Delacon has no need to name a designated DPO, as Article 37 (1) of the GDPR is not applicable.

However, in line with the importance of data protection, Delacon has decided to appoint a data protection officer on a voluntary basis. He is available to the data subjects and the supervisory authority as a point of contact and takes care of privacy issues in the group companies.

7. Rights of the data subject

Any data subject whose personal data is processed by Delacon has at all times the opportunity to rely on the data subjects’ own rights and assert them with the Delacon Data Protection Officer.

Right of access

Data subjects may at any time request information about which personal data is processed about them and which purposes this processing serves.

Right to rectification

Data subjects have the right to demand the immediate correction of incorrect or incomplete personal data concerning them.

Right to restriction of processing

Data subjects have the right to request the restriction of processing if the accuracy of the data concerning them is disputed, the processing is unlawful, the data is no longer needed for processing or the data subject has objected to the processing.

Right to object

Data subjects have the right to object to the processing of personal data concerning them at any time.

Right to data portability

Data subjects have the right to receive the personal information they have provided to Delacon in a structured, common and machine-readable format. They also have the right to request the transfer of this data to another controller, if technically feasible.

The data portability applies only to personal data that is processed using automated procedures.

Right to erasure – right to be forgotten

The data subject has the right to demand immediate deletion of the personal data concerning him / her if the legal basis for the processing of the data is missing or omitted, the data processing is objected or the data processing is unlawful and no legal retention periods make deletion impossible.

Data security also has a high priority with regard to the rights of the victims, which is why the assertion of data subject rights is only possible after a doubtless identification of the data subject.

You also have the right to lodge a complaint with supervisory authority at any time.

 

8. Data transfer

A transfer of personal data to recipients outside the company group and recipients in third countries will only be conducted in accordance with applicable laws, on a lawful basis and with the utmost confidentiality and data security.

Delacon commissioned various processors with specific processing activities. All processors are contractually bound to comply with applicable data protection regulations by a processor agreement.

The continuous improvement of quality and processes is very important to Delacon

Compliance with data protection policies, applicable legislation and the effectiveness of data protection and data protection measures is constantly being measured and improved to ensure the best possible data protection practices.
